Terms of use

1. Agreement and eligibility

These Terms of Use form an agreement between you and the developer of UglyStart ("UglyStart", "we", "us", or "our"). By downloading, accessing, purchasing, or using UglyStart, you agree to these Terms.

You may use UglyStart only if you are legally able to agree to these Terms yourself or, if you are a minor where you live, a parent or legal guardian reviews and accepts these Terms on your behalf. A parent or legal guardian who accepts on a minor's behalf becomes a party to these Terms and is responsible for supervising the minor's use of UglyStart as required by applicable law.

If you do not agree to these Terms, do not use UglyStart.

2. What UglyStart provides

UglyStart is an anti-procrastination tool. It can turn a task you enter into a smaller first action, run a short countdown, record starts on your device, schedule optional reminders, and provide related app features.

UglyStart provides general productivity and wellness support for starting tasks. It is not medical care, diagnosis, treatment, or an emergency service. It does not complete tasks for you, monitor whether a task is safe, or guarantee any particular personal, educational, health, or professional outcome.

3. First-action suggestions

On compatible devices, some first-action suggestions are generated using Apple’s on-device Foundation Models when the system model is available. When it is unavailable or a generated result cannot be used, UglyStart uses curated local templates instead. Template suggestions are not AI-generated.

The current launch configuration does not send task text to an UglyStart proxy or Anthropic for task shrinking. Remote processing may be enabled only if deliberately configured in a future version; if that happens, task text may be sent through our service-provider infrastructure to an AI provider as described in our Privacy Policy.

Any suggestion, whether AI-generated or template-based, can be incorrect, incomplete, inappropriate, or unsuitable for your circumstances. Review each suggestion before acting on it. Do not rely on UglyStart as a source of factual, safety-critical, or professional guidance.

UglyStart does not provide medical, mental health, legal, financial, employment, or other professional advice. If a task involves safety, health, law, money, or another high-impact decision, consult a qualified professional.

The source and quality of suggestions can vary by device, operating system, Apple Intelligence availability, and task.

4. Subscriptions and billing

Some UglyStart features require an auto-renewable subscription purchased through Apple's In-App Purchase system. Available plans, billing periods, localized prices, included features, and any introductory offer are shown in the app before you confirm a purchase.

When you purchase, payment is charged to the Apple Account associated with your App Store purchase. Your subscription renews automatically for the same billing period unless you cancel it before the end of the current period. Apple may charge your account shortly before renewal.

Apple, not UglyStart, processes payment credentials and manages billing. Taxes and currency conversion may vary based on your App Store region and Apple's terms.

We may change the features included in a subscription where permitted by law. Any subscription price change is handled through Apple and is subject to Apple's notice and consent rules.

5. Free trials and offers

If Apple shows that you are eligible for a free trial or introductory offer, the offer lasts for the period displayed before purchase. Eligibility is determined by Apple and may be limited to new or otherwise eligible subscribers.

Unless you cancel before the trial or offer ends, it converts to the paid subscription shown at confirmation and renews automatically. Canceling during a free trial may affect access immediately or at the end of the trial, depending on Apple's rules.

Only rely on the offer details shown in Apple's purchase confirmation sheet. Promotional wording elsewhere does not override that confirmation.

6. Cancellation and account management

You can cancel at any time through your Apple Account subscription settings. Deleting UglyStart does not cancel a subscription.

To manage or cancel, open Settings on your Apple device, select your Apple Account, choose Subscriptions, select UglyStart, and follow Apple's instructions. You can also use Apple's subscription management tools where available.

After cancellation, paid access normally continues until the end of the current billing period unless Apple states otherwise. We cannot cancel a subscription on your behalf.

7. Refunds

Apple processes payments and decides App Store refund requests under its policies and applicable law. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

Nothing in these Terms limits any refund, cancellation, or other remedy that cannot legally be limited where you live.

8. Licence to use the app

UglyStart is licensed, not sold. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded products you own or control, as permitted by Apple's usage rules.

Apple's Standard End User Licence Agreement also applies. If these Terms conflict with Apple's mandatory terms for the app licence, Apple's mandatory terms control to the extent of that conflict.

You may not copy, sell, sublicense, rent, distribute, reverse engineer, interfere with, or create derivative works from UglyStart except where applicable law does not allow that restriction.

9. Your content and privacy

You keep any rights you have in task text and other content you enter. You give us a limited permission to process that content only as needed to operate, secure, and provide UglyStart, including generating requested first-action suggestions.

You are responsible for the content you submit and must have the right to use it. Avoid entering confidential information, authentication credentials, payment-card details, health records, or other highly sensitive personal information.

Our Privacy Policy describes what data is processed, the service providers involved, retention, and your choices.

10. Acceptable use

You may not use UglyStart to:

• break the law, facilitate harm, threaten others, or violate another person's rights;
• submit content that is unlawful, abusive, exploitative, fraudulent, or infringing;
• probe, disrupt, overload, bypass, or gain unauthorized access to the app, subscription systems, or connected services;
• circumvent usage limits, payment requirements, security controls, or access restrictions;
• extract, scrape, resell, or use the service to build or train a competing model or product; or
• use suggestions for automated decisions that have legal or similarly significant effects on another person.

When AI features are available, they may also be subject to applicable platform or provider safety and usage restrictions. We may limit or suspend access when reasonably necessary to protect users, providers, or the service, or to comply with law.

11. Availability and changes to the service

UglyStart depends on device capabilities, Apple services, RevenueCat, and other third-party systems. Features may be delayed, unavailable, interrupted, or different across devices, languages, regions, and operating-system versions. Speech Recognition, purchases, support links, and any remote service deliberately enabled in the future may require internet access.

We may modify, replace, suspend, or discontinue features. We will not intentionally remove paid access during an active subscription period without providing the service, a reasonable substitute, or a remedy required by applicable law.

You are responsible for maintaining a compatible device, supported software, and internet access where a feature needs it.

12. Disclaimers

To the fullest extent permitted by law, UglyStart is provided "as is" and "as available." We do not promise that the app will always be available, error-free, secure, or suitable for every task, or that using it will produce a specific result.

Timers, reminders, notifications, Live Activities, widgets, transcriptions, and suggestions may be delayed, interrupted, or inaccurate. Do not rely on UglyStart for emergencies, deadlines where failure would cause serious harm, or safety-critical activity.

These disclaimers do not exclude warranties, guarantees, or statutory rights that cannot be excluded under the law that applies to you.

13. Responsibility and liability

You are responsible for deciding whether and how to act on a task or suggestion. To the fullest extent permitted by law, UglyStart and its developer are not liable for indirect, incidental, special, consequential, or punitive loss arising from your use of or inability to use UglyStart.

Where liability cannot be excluded, our aggregate liability relating to UglyStart will not exceed the greater of the amount you paid for UglyStart during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited. Your mandatory consumer rights remain unaffected.

14. Suspension, termination, and changes

You may stop using UglyStart at any time. Cancellation of a paid subscription is handled as described above.

We may suspend or terminate access if you materially breach these Terms, misuse the service, create risk or legal exposure, or if a provider requires us to do so. Where reasonable, we will provide notice and an opportunity to address the issue.

We may update these Terms to reflect service, provider, legal, or security changes. We will post the revised Terms with a new effective date and provide any additional notice required by law. Continuing to use UglyStart after revised Terms take effect means you accept them, except where law requires another form of consent.

These Terms do not override mandatory consumer protections that apply where you live. Any dispute, claim, or remedy remains subject to applicable law and any rights you have to bring a claim through a court or process available to you.

If any provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent, but we may transfer it as part of a reorganization, financing, merger, acquisition, or sale of the service, subject to applicable law.
